Terms of Service

Choontune is an AI-powered music generation platform specialising in South African music genres, including Amapiano, Gqom, Kwaito, Afro House, and SA Jazz. The Service allows users to generate, remix, and export AI-generated music tracks using machine learning models.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and that your use of the Service complies with all applicable laws and regulations in South Africa.

To access the Service, you must register for an account using a valid South African mobile phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@choontune.co.za if you suspect any unauthorised use of your account.

Choontune offers subscription plans with the following pricing (all amounts in South African Rand, inclusive of applicable taxes):

• Free — R0/month. 5 tracks per month. Standard quality.
• Creator — R99/month. 50 tracks per month. HD quality. Stem separation. Commercial rights.
• Pro DJ — R199/month. Unlimited tracks. Ultra HD quality. Stem separation. Commercial rights.
• Studio — R499/month. Unlimited tracks. Ultra HD quality. All features. 5 team seats.

Billing is processed via Paystack, a licensed payment service provider. Your first payment is prorated based on the number of days remaining until your chosen billing date. Recurring payments are charged on your selected billing date each month. By subscribing, you authorise Choontune and Paystack to charge your payment method on a recurring basis until you cancel.

Your content: You retain ownership of any prompts, descriptions, and inputs you provide to the Service.

Generated tracks: For paid subscribers (Creator, Pro DJ, Studio), Choontune grants you a worldwide, royalty-free licence to use, reproduce, distribute, perform, and display the AI-generated tracks you produce through the Service, including for commercial purposes. For Free tier users, generated content is for personal, non-commercial use only.

Choontune IP: The Service, including the platform, models, interfaces, and underlying technology, remains the sole property of Choontune (Pty) Ltd. You may not reverse-engineer, decompile, or attempt to extract the underlying models or algorithms.

Training data disclaimer: AI-generated outputs are produced by machine learning models. Choontune does not guarantee that any output is free from similarity to existing works. You use generated content at your own risk.

You agree not to use the Service to:

• Generate content that infringes the intellectual property rights of third parties
• Generate content that is defamatory, hateful, discriminatory, or incites violence
• Attempt to circumvent usage limits or access controls
• Scrape, crawl, or systematically extract data from the Service
• Resell access to the Service or provide the Service to third parties on a commercial basis without our written consent
• Violate any applicable law, including the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Cybercrimes Act 19 of 2020

Track generation is subject to monthly limits based on your subscription tier (see Section 4). Unused track generation credits do not roll over to the following month. Choontune reserves the right to throttle or suspend accounts that abuse the Service.

Choontune provides the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. Scheduled maintenance will be communicated via the platform or email where practicable.

To the maximum extent permitted by South African law, Choontune shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profits, or loss of data, arising from your use of or inability to use the Service. Our total liability to you shall not exceed the total fees paid by you in the 3 months preceding the claim.

You agree to indemnify and hold harmless Choontune (Pty) Ltd, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your violation of these Terms or your use of the Service.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Gauteng, South Africa. We encourage you to contact us at support@choontune.co.za first to resolve any dispute informally.

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notification. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
